§ 1 General Provisions

1.1.

These Terms and Conditions set out the rules governing the provision of electronic services through the website JestemSlowem.pl by the Jestem Słowem Foundation, having its registered office in Poznań, Poland, at ul. Naramowicka 266C, 61-601 Poznań, registered under:

1.2.

Matters not governed by these Terms and Conditions shall be subject to the applicable provisions of Polish law, including in particular:

• the Act of 18 July 2002 on the Provision of Electronic Services;
• the Act of 30 May 2014 on Consumer Rights; and
• the Polish Civil Code of 23 April 1964.

§ 2 Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

2.1. Terms and Conditions

These Terms and Conditions governing the provision of electronic services within the meaning of Article 8(1) of the Polish Act on the Provision of Electronic Services.

The Service Provider delivers electronic services via the Website.

2.3. Donor

Any natural person with full legal capacity, legal entity or organisational unit without legal personality but possessing legal capacity under applicable law, using the electronic services provided by the Service Provider.

2.4. Consumer

A Donor who is a natural person acting outside the scope of their trade, business, craft or profession and who concludes an agreement with the Service Provider for the provision of electronic services.

The Service Provider’s website available at:

2.6. Website User

Any natural person, legal entity or organisational unit browsing or using the Website.

2.7. Services

Electronic services provided via the Website, including in particular:

• enabling Users to conclude online agreements for goods and services offered by the Service Provider;
• accepting online donations supporting the statutory activities of the Foundation;
• providing access to additional Website functionalities, including the creation and maintenance of a personal user account.

2.8. Digital Products

Digital content offered by the Service Provider through the Website, including electronic publications (e-books), supplied exclusively in digital form.

§ 3 Scope of Services

3.1.

Through the Website, the Service Provider offers electronic services consisting of:

Enabling Users to purchase goods and services online, including digital products such as printed books and e-books offered by the Service Provider.

3.1.2.

Providing access to additional Website features, including the option to create and manage a personal user account.

3.1.3.

Allowing Users to make online voluntary contributions supporting the statutory activities of the Foundation in the form of symbolic donations (“support contributions”).

3.2.

The Website contains detailed information regarding the products and services offered by the Service Provider, including descriptions, content, pricing and availability.

3.3.

The Service Provider reserves the right to modify prices, withdraw products or services from sale, introduce new products or services, and apply promotional discounts at any time. Such changes shall not affect agreements concluded before the changes take effect.

3.4.

The Service Provider reserves the right to organise promotional campaigns and marketing activities.

3.5.

Unless stated otherwise, all prices displayed on the Website are expressed in Polish Złoty (PLN) and include VAT where the Service Provider is legally required to charge VAT and is not exempt from doing so under applicable tax regulations.
